Myoko Kogen town decided not to appeal and to admit the negligence of the school. It accepted the decision by the Nigata District Court Takada Branch to pay compensation of about 34 million yen to the parent of a judo club member of Myoko Junior High School who died after practice at school. The student who was a first year student, died due to hitting his head during judo training.
The decision given on Jan. 30 supported most of the claims made by the student’s parents, emphasizing that the judo club teacher could have cancelled the practice or arranged another teacher to supervise the club. Payment of about 34 million yen by the town against the claim of about 66 million 70 thousand yen was ordered.
The town had already paid 22 million yen in condolence money after the death of the student. The parents filed a lawsuit the following year because the responsibility and negligence of the school was not clearly defined. The decision states that the condolence money should be included as part of the compensation.
